Flipkart, denoted as “We” or “Flipkart,” represents Flipkart Internet Private Limited. The websites www.flipkart.com and https://seller.flipkart.com collectively form the Flipkart Websites. These platforms are pivotal for your e-commerce journey and are individually referred to as “Flipkart Website” when applicable.

“Flipkart Policies” encompass the regulations and policies listed on https://seller.flipkart.com/LearningCenter/policies, which all sellers must familiarize themselves with. It’s your responsibility as a Flipkart Seller to ensure compliance with all relevant laws, rules, and regulations, be they central, state, local, or municipal, at the time of listing or selling any item on the Flipkart Website.

Crucially, you must refrain from listing or selling any product that violates either the laws of the land or Flipkart’s Policies. It falls squarely on your shoulders as a Flipkart Seller to confirm that the products you intend to sell online are permissible for sale and do not contravene any prohibitions or restrictions imposed by the prevailing laws of the land or the Flipkart Policies.   3. Confirm that you possess the legal and contractual rights to sell the products you list on Flipkart.
  4. Obtain any necessary licenses, authorizations, consents, permissions, etc., as required under extant laws, for any items you wish to list on the Flipkart Website.

The consequences of violating these policies are significant. SCHEDULE – 1: LIST OF PROHIBITED ITEMS:

This reference enumerates the types of products that cannot be listed on Flipkart’s websites. However, it’s important to note that this list is not exhaustive. As a responsible Flipkart Seller, you are expected to commit to selling only products or services that align with the applicable laws of the land, as well as state, national, or international regulations, and Flipkart’s Policies.

We have made efforts to include some prohibited items in the list provided herein, based on inputs from relevant stakeholders, including the user community. Nevertheless, in the case of items missing from this list, sellers must, at all times, adhere to all applicable laws of the land and comply with Flipkart’s Policies. Please be aware that this list of prohibited items is subject to change, so we advise you to check this page regularly for updates on both prohibited and restricted items.

SCHEDULE – 2: KNOW YOUR SELLER ACTION FRAMEWORK:

In our commitment to maintaining the highest Flipkart Seller standards and increasing awareness of Flipkart’s Policies, we have introduced a Compliance Seller Action Framework. This framework outlines the consequences for policy violations, taking into consideration the severity and criticality of non-compliance.

Seller Warnings

The seller receives a warning email from Flipkart, it includes suggestions for necessary remediation. Additionally, please note that Flipkart prohibits the listing of the product for which the warning has been issued.

Seller Account “on-hold” for 7 days

Upon receiving a notification email from Flipkart, sellers are informed of the suspension of all activities on their Flipkart Seller account for a duration of one week, effective from the date of the email notification. This email will also contain recommendations for necessary remediation.

During this suspension period, sellers have the option to make the required corrections to ensure compliance with Flipkart Policies and the applicable laws of the land. Once these adjustments are made, the products can be listed once again on the Flipkart Website.

It’s important to note that Flipkart does not permit the listing of the product for which the “Account Suspension” action with a 7-day hold has been initiated. Furthermore, sellers will not be able to perform any activity on their Flipkart Seller account for the entire week following the date of the email notification.

Seller Account“ Permanently on-hold

The seller will receive an official notification email from Flipkart, stating the permanent cancellation of their Flipkart Seller account, effective immediately from the date of the email notification. This cancellation results in the seller being prohibited from engaging in any further transactions with Flipkart.

This level of action is typically taken when one or more of the following conditions apply:

  • The seller has repeatedly violated Flipkart Policies and the applicable laws of the land.
  • There is clear evidence of the seller’s malicious intent to circumvent system controls, deceive customers, or violate relevant compliance and regulatory policies. Such evidence may carry severe legal consequences, potentially leading to criminal proceedings against Flipkart and its directors (please refer to point-d: “Exceptions to the Consequence Path” below).

In cases where there is clear evidence of the seller’s malicious intent to evade system controls, deceive consumers, or violate applicable compliance and regulatory requirements by listing prohibited products, severe legal consequences may arise. These consequences may extend to criminal proceedings against Flipkart or any associated parties. Instances of such malintent may encompass various actions, including but not limited to:

  • Altering product images in a deceptive manner.
  • Unauthorized use of intellectual property rights belonging to others without the necessary consent or authority.
  • Manipulating product attributes and brand names, including intentional misspellings.
  • Omitting critical product attributes to bypass system controls, such as highlighting certain features.
  • Cross-listing, which involves listing prohibited products in categories not configured with appropriate safeguards.

These violations not only expose Flipkart to potentially serious legal repercussions, including criminal proceedings but can also negatively impact the well-being and trust of our valued customers. As a result, Flipkart reserves the right to take decisive and immediate actions against such sellers, which may include the permanent suspension of the seller’s account.
